Graphic Design Policy & Terms of Service
These Graphic Design Terms of Service (“Terms”) govern all design services provided by K2 Print Co. (“Designer,” “we,” or “us”) to the client (“Client,” “you”). By engaging our services, you agree to the following:
1. Ownership & Intellectual Property
1.1. All design concepts, drafts, and materials created during the design process remain the intellectual property of the Designer until full payment has been received.
1.2. Upon receipt of full payment, ownership of the final, approved design is transferred to the Client, subject to the limitations outlined herein.
1.3. The Designer reserves the right to display completed works for self-promotional purposes, including portfolios, websites, and marketing materials, unless otherwise agreed in writing.
2. Revisions & Modifications
2.1. Projects include a maximum of 3 rounds of revisions unless otherwise stated in the project agreement.
2.2. Revisions are limited to reasonable changes to the existing design. Major alterations, redesigns, or additional concepts will be treated as new work and billed accordingly.
2.3. Once final approval is given by the Client, any further changes will incur additional charges.
3. Proof Approval & Liability
3.1. Proofs will be submitted to the Client for review prior to finalization.
3.2. The Client is solely responsible for reviewing all proofs for accuracy, including but not limited to spelling, grammar, layout, and color.
3.3. The Designer shall not be held liable for errors, omissions, or damages resulting from proofs approved by the Client.
4. Deliverables & File Formats
4.1. Final deliverables will be provided in industry-standard formats (e.g., PNG, JPEG, PDF, SVG, or AI, as agreed).
4.2. Editable source files may be provided upon request and may be subject to an additional fee.
4.3. The Designer is not responsible for technical compatibility issues once files have been delivered in the agreed-upon format.
5. Payment Terms
5.1. A non-refundable deposit of $60 is required before work commences.
5.2. The remaining balance must be paid in full prior to the release of final files.
5.3. Late payments may be subject to interest or service fees as permitted by law.
5.4. Graphic design services beyond the addition of a simple logo to products are billed at $60 per hour, unless otherwise agreed in writing.
6. Cancellation & Refunds
6.1. Deposits are non-refundable.
6.2. If the Client cancels a project after work has commenced, the Client will be billed for the portion of work completed up to the cancellation date.
6.3. No refunds will be issued once final files have been delivered.
7. Usage Rights & Restrictions
7.1. Upon transfer of ownership, the Client is granted rights to use the final design(s) for personal or commercial purposes as specified in the project agreement.
7.2. The Client may not resell, sublicense, redistribute, or alter the design in a way that misrepresents the Designer’s work.
7.3. All rights not expressly transferred to the Client remain with the Designer.
8. Turnaround Time & Deadlines
8.1. Estimated timelines will be communicated prior to project commencement.
8.2. Delays caused by Client in providing necessary materials, feedback, or approvals may extend deadlines.
8.3. Rush services may be available for an additional fee.
9. Limitation of Liability
9.1. The Designer shall not be liable for any indirect, incidental, or consequential damages arising from the use of the final design.
9.2. The Client assumes responsibility for the use, reproduction, and distribution of the final design.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Wisconsin, without regard to conflict of law principles.
